Employment Law This Week® – Episode 39 – Week of August 22, 2016 – 844-292-1318 West Virginia legal aid

Welcome to Employment Law This Week® ! Subscribe to our channel for new episodes every Monday!

This week’s stories include . . .

(1) SEC Cracks Down on Anti-Whistleblower Provisions – http://bit.ly/2b4novX

Our top story: The Securities and Exchange Commission (SEC) cracks down on anti-whistleblower provisions. The SEC has charged BlueLinx Holdings with violating anti-whistleblower protections in its severance agreements. The company required all exiting employees to sign an agreement waiving their rights to whistleblower payments. Without admitting or denying any wrongdoing, BlueLinx agreed to amend its severance agreements and pay 5,000 to settle with the SEC. Less than a week later, the agency settled with a health care company on similar charges, for 0,000. Since the spring of 2015, the SEC has charged four companies for discouraging whistleblower activity. Tamara Bock, from Epstein Becker Green, has more.

“The SEC charged two different companies with alleged violations of 21F-17 of the Securities and Exchange Commission. This is part of a targeted sweep that the SEC has been conducting since the fall of 2014. Companies should review their employment agreements, and if they have a provision stating that employees may not collect awards in connection with sharing information with government agencies—which, by the way, is allowed by many agencies—then that company should create a specific carve-out for communications with the Securities and Exchange Commission.”

(2) Nonprofit Loses Federal Wage Exemption – http://bit.ly/2bD7WCH

A nonprofit’s federal minimum wage exemption is revoked. To promote the hiring of the disabled, employers can obtain certificates from the Department of Labor (DOL) and pay subminimum wages to certain disabled workers. But a community rehabilitation center in West Virginia failed to do the studies needed to determine the proper wage rate and didn’t pay a valid subminimum wage to the disabled workers. That’s according to the DOL, which revoked the organization’s certification. This is a part of a larger strategic initiative from the DOL to ensure that all disabled workers are protected from exploitation.

(3) California Company Settles Reimbursement Suit – http://bit.ly/2bDuRPl

A distinction in California law has led to a reimbursement suit settlement. Medical device manufacturer Synthes has agreed to a proposed million settlement with its California-based sales consultants. The sales consultants accused the company of making illegal wage deductions and failing to reimburse expenses. Unlike in most states, California’s Labor Code requires reimbursement for work-related expenses. The company settled but denied any wrongdoing or liability.

(4) DOL Revises FLSA and EPPA Posters – http://bit.ly/2bQ3yV9

The Department of Labor updates two mandatory posters. The DOL recently released updated versions of its mandatory Fair Labor Standards Act (FLSA) and Employee Polygraph Protection Act (EPPA) posters. The DOL made several changes to the revised posters, including removing the penalty amount for violations. The new FLSA poster also includes various additions, such as information about the rights of nursing mothers. As of August 1, 2016, employers are required to post the updated versions, which can be downloaded from the DOL’s website.

News Wrap: Flood-ravaged West Virginia braces for more rain – 844-292-1318 West Virginia legal aid

In our news wrap Monday, a new round of storms pounded West Virginia, where more than 20 counties braced for additional flooding. Since last week, floods have killed nearly two dozen people across the state. Also, a California wildfire consumed 250 homes and other buildings, stoked by record-breaking heat and ongoing drought.

In the past the deceased have won elections, but in West Virgina a convicted felon trailed President Obama in the state’s Democratic primary. Keith Judd, who is serving a 17 and a half year prison sentence, took 41 percent of West Virginia’s democratic primary votes, but couldn’t beat Obama’s 59 percent. Ann Larson, activist for Occupy Student Debt Campaign, joins us for more on Obama.

Robbery Suspect Shot by Concealed Carry Pharmacist/ www.bioskop303.com – 844-292-1318 West Virginia legal aid

Robbery Suspect Shot by Concealed Carry Pharmacist
This happened where I’m from in WV. The little pharmacy is in a building that once was an ice cream shop where I spent a lot of time and money as a young adult and is on the lot adjacent to the childhood home of one of the best friends a man could ever hope to have in life. Shit like this just doesn’t go on in my community (suspect was from out of town) thanks to fast acting and thinking legal concealed carriers like this man.
Original story:
Kanawha County, WV Sheriff’s deputies are investigating a shooting that occurred at Good Family Pharmacy in Pinch, WV located in the 200 block of North Pinch Road.
According to deputies on scene, a pharmacist shot a suspect who was trying to rob the store around 10:30 a.m. Wednesday, February 18, 2015.
There is no word on the extent of injuries to the attempted robbery suspect.
Update:
According to detectives with the Kanawha County Sheriff’s Office, the suspect who was shot while attempting to rob Good Family Pharmacy in Pinch, West Virginia has died from the injuries he sustained.
The identity of that man has been identified as 25 year old, Terry Gillenwater.
Detectives said after the pharmacist on staff shot him, staff began performing first aid on the suspect. He was transported to CAMC General Hospital in Charleston, where he later died.

www.fieldsdehmlow.com What is eminent domain? Government takes private property for a public use. You can dispute a ruling of eminent domain as the government is required to have a “public purpose” for the land. Disputes also center around “just compensation” for the property.

There are multiple levels of bureauracracy to navigate, and ultimately there is a right to a jury trial if disputes cannot be resolved in eminent domain cases.

Both the state and property owner can present evidence of value at the trial.

Also of concern is damage to ‘residual property’ – property that was not included in the ruling of eminent domain, but was damaged in the construction or use of the property that was included.

Find an attorney with experience in eminent domain cases, do not wait until it is too late. You have a righ to legal assistance, and will surely need advice to combat the state’s legal team.

Visit www.fieldsdehmlow.com for more information, or call 740-374-5346 today. The law firm of Fields, Dehmlow & Vessels has experience in eminent domain cases in both West Virginia and Ohio.
